The Grand Escape Tuscany è un raduno ciclistico non competitivo riservato esclusivamente ai tesserati della Bikepacking Adventures ASD (d’ora in poi definito anche evento o impropriamente gara o corsa o avventura).

Art. 1 – Iscrizione
Sono ammesse al raduno tutte le persone che hanno compiuto il 18° anno di età al momento dell’iscrizione appartenenti ad ogni nazionalità.

Art. 2 – Affiliazione
The Grand Escape Tuscany è un evento riservato esclusivamente ai tesserati della Bikepacking Adventures ASD .
Chi non è tesserato della suddetta società sportiva lo diventerà al momento dell’iscrizione all’evento.
L’Organizzazione potrà in ogni momento e a suo insindacabile giudizio decidere se accettare o meno l’iscrizione oppure escludere un iscritto dalla manifestazione nel caso possa arrecare danno all’immagine della stessa.

ART. 3 – Certificato medico

Per tutti i partecipanti è OBBLIGATORIO presentare all’organizzazione il certificato medico attitudinale per la pratica ciclistica (Certificato Medico Agonistico per il Ciclismo o in alternativa Certificato di idoneità alla pratica di attività sportiva di particolare ed elevato impegno cardiovascolare o) e conforme al DM 26/04/2013 rilasciato da un Centro Medico Sportivo o da un Medico, in corso di validità. Il certificato medico deve avere scadenza successiva al 9 settembre 2023 e deve essere caricato in fase di iscrizione.

Il certificato medico dovrà essere inviato via mail a info@thegrandescape.cc Dovrà essere anche specificata la data di scadenza del certificato medico.

Qualora il certificato medico non fosse conforme, verrà rifiutato e cancellato e l’iscritto dovrà provvedere a inoltrare uno nuovo conforme entro il 30 giugno 2023.

Il Certificato Medico Agonistico deve essere specifico per il CICLISMO. Non possiamo accettare certificati medici emessi per altre discipline sportive quali triathlon, atletica leggera, ecc.

Chi non ottempererà a tale prescrizione non sarà ritenuto iscritto regolarmente e non ha diritto al rimborso della quota di iscrizione.

Ogni partecipante dovrà dichiarare ai sensi del D.P.R. n. 445 del 28 dicembre 2000 che i documenti da lui inoltrati sono veritieri e corrispondono agli originali in suo possesso.

Art. 4 – Percorso e traccia

Il percorso parte da Castagneto Carducci (LI) e termina a Castagneto Carducci (LI). Il percorso ha una lunghezza di circa 600 km circa. Il tracciato si sviluppa su strade asfaltate.
L’organizzazione fornirà a tutti i partecipanti una traccia in formato .gpx del percorso da seguire fino all’arrivo, ma si ricorda che, in qualsiasi momento e per qualsiasi motivo legato alla sicurezza, così come alle condizioni del traffico e della viabilità, compresi lavori stradali, deviazioni, divieti e ogni altra situazione imponderabile che è possibile incontrare lungo il tracciato che abbiamo fornito, ognuno è libero, a propria discrezione, di lasciare il tracciato e riprenderlo non appena queste condizioni critiche saranno cessate e la sicurezza sarà nuovamente garantita. Si può quindi deviare dalla traccia fornita in qualsiasi momento per poi riprenderla in seguito, utilizzando strade alternative a propria discrezione, se le condizioni lo richiedono.
L’organizzazione si riserva la facoltà di modificare il percorso fino a pochi giorni prima della partenza.

Art. 5 – Partenza collettiva

Il programma dettagliato dell’evento sarà disponibile per ogni partecipante via email.

Art. 6 – Rispetto del codice della strada
The Grand Escape Tuscany è una PASSEGGIATA IN LIBERA ESCURSIONE su strade sterrate, sentieri e strade asfaltate; tutto il percorso sarà sempre aperto al traffico e pertanto è obbligatorio per tutti i partecipanti il rispetto del Codice della Strada. È inoltre obbligatorio avere un kit per le riparazioni dei guasti e per le forature.

Art. 7 – Caratteristiche della manifestazione – avvertenza
Tutti i partecipanti devono:

Nello spirito del bikepacking è vietato qualsiasi tipo di supporto esterno (tranne ovviamente in casi di emergenza).

Art. 8 –  Kit obbligatorio
Per la propria sicurezza personale, in caso di emergenza o perdita del percorso, ogni partecipante è obbligato a trasportare con sé, per tutta la durata della propria avventura, il seguente equipaggiamento minimo di sicurezza:

• gilet catarifrangente
• fischietto o campanello
• cellulare
• casco omologato da indossare sempre
• luci anteriore bianca e posteriore rossa

Art. 9 – Iscrizioni e quota di partecipazione

L’iscrizione comprende:

Art. 10 – Validità dell’iscrizione
L’iscrizione si potrà ritenere regolarmente valida solo dopo aver concluso la procedura elettronica di iscrizione con conseguente accredito elettronico dell’importo a favore dell’organizzatore e invio del certificato medico che dovrà essere inviato entro il 30 giugno 2023 all’email info@thegrandescape.cc.
L’organizzazione potrà, in ogni momento ed a suo insindacabile giudizio, senza obbligo di ulteriore motivazione, decidere se accettare o meno l’iscrizione di chiunque.

Art. 11 – Sostituzione e rinunce alla partecipazione
Con riferimento all’Evento, non è possibile chiedere la sostituzione di un partecipante una volta iscritto. Qualora un iscritto non partecipi all’evento la quota di partecipazione non verrà rimborsata in alcun caso e non è prevista la spedizione del pacco gara.

Art. 12 – Annullamento o spostamento della manifestazione
Annullamento – Se, per cause di forza maggiore come ad esempio pandemie o guerre la manifestazione non dovesse svolgersi, l’importo versato al momento dell’iscrizione non sarà rimborsato, ma la sola quota di partecipazione sarà considerata valida in caso di richiesta di iscrizione all’edizione successiva. L’organizzazione avrà inoltre diritto ad un contributo riguardante le spese di assicurazione pari a €14,00 per lo slittamento dell’iscrizione all’anno successivo . La richiesta di iscrizione all’anno successivo e il versamento del contributo di segreteria dovranno avvenire entro la data indicata dall’organizzazione dopo l’annullamento dell’evento.
Spostamento – Inoltre per cause di forza maggiore o altri gravi motivi, quali a titolo di esempio pandemie o guerre, che dovessero mettere a rischio la preparazione dell’evento o la partecipazione allo stesso da parte di un numero di persone non inferiore alla metà degli iscritti, l’Organizzazione si riserva il diritto di spostare il luogo e/o la data dell’evento entro lo stesso anno di calendario. In questo caso la quota versata per l’iscrizione sarà valida per l’evento alla data riprogrammata, senza aggravio di costi per gli iscritti. Non è possibile in questo caso lo spostamento dell’iscrizione all’edizione dell’anno successivo.

Art. 12 – Variazioni
A fronte di sopravvenute nuove circostanze ambientali e/o sanitarie e/o in caso di modifiche del quadro normativo, l’Organizzazione si riserva in qualsiasi momento la facoltà di apportare le conseguenti ragionevoli variazioni al regolamento. Il sito internet ufficiale dell’evento dove è pubblicato questo regolamento costituisce l’unico riferimento di informazione sulla manifestazione. Non potranno pertanto essere invocati eventuali diversi contenuti presenti in precedenti comunicazioni via newsletter, sugli organi di stampa o sui social media.

Art. 13 – Approvazione, consenso, autorizzazione, etc.
Chiedendo di partecipare a The Grand Escape Tuscany ogni partecipante al momento dell’iscrizione:
• Dichiara di avere letto e approvato il presente Regolamento e di accettarne ogni sua parte;
• Si costituisce garante del proprio comportamento durante e dopo la manifestazione;
• Dichiara di essere in buone condizioni fisiche e di aver consegnato all’organizzazione un certificato medico valido dopo essersi sottoposto a visita medico attitudinale per la pratica ciclistica, fornendo all’organizzazione la più ampia manleva per ogni danno che dovesse subire in conseguenza della sua partecipazione alla manifestazione;
• Dichiara di aver preso conoscenza che la manifestazione alla quale partecipa è una prova non competitiva e senza classifiche;
• Dichiara di essere consapevole che non è presente alcun servizio di assistenza sanitaria, alimentare e meccanica da parte degli organizzatori della manifestazione ciclistica denominata The Grand Escape Tuscany;
• Dichiara di essere consapevole che non è presente nessun servizio di recupero dei ritirati, né sussistono obblighi da parte degli organizzatori di ricerca dei partecipanti sul percorso;
• Dichiara di essere consapevole che non esiste nessun obbligo da parte dell’organizzazione di presidiare le strade attraversate dai ciclisti partecipanti;
• Dichiara di essere consapevole che la quota di partecipazione non verrà rimborsata in alcun caso;
• Dichiara di avere esperienza e essere consapevole della possibilità di incontrare avverse condizioni meteo e di essere in grado di orientarsi e pedalare in collina e media montagna in tali condizioni;
• Dichiara di essere consapevole che l’organizzatrice “Bikepacking Adventures ASD” non è un ente organizzatore professionale, ma la stessa agisce per soli fini ludici e non patrimoniali (1174 Cod.civ.); e quindi la partecipazione al The Grand Escape Tuscany avviene sempre per libera scelta e per fini ludici, comunque non patrimoniali. Ne consegue pertanto che la ASD organizzatrice sopracitata è priva, e in ogni caso manlevata, da qualunque responsabilità connessa all’escursione The Grand Escape Tuscany. E’ altresì manlevata da qualsiasi responsabilità riguardante evenienze accadute al ciclista durante ilThe Grand Escape Tuscany quali ad esempio: sinistri, smarrimento del percorso, problemi fisici, incidenti, furti ecc. Ne consegue pertanto che l’escursione ciclistica The Grand Escape Tuscany è da intendersi quale mera riunione a partecipazione spontanea ed indipendente di cicloturisti e cicloamatori in escursione libera e personale; – che per puro spirito di ospitalità e cortesia senza i requisiti ex art 1174 e ss Cod.civ. la ASD organizzatrice sopracitata può organizzare uno o più ristori per i partecipanti, soggetti a contribuzione volontaria, che il ciclista si impegna a versare prima di affrontare l’escursione ciclistica The Grand Escape Tuscany;
• Dichiara che, pertanto, il ciclista che partecipa all’escursione ciclistica The Grand Escape Tuscany, rinunzia a intraprendere qualsiasi azione legale a qualsiasi titolo nei confronti della ASD organizzatrice sopracitata, riconoscendo che la stessa è una associazione non professionale che agisce per fini ludici privi dei requisiti (ex art 1174 Cod.civ.)
• Esprime il consenso all’utilizzo dei suoi dati, anche a fini commerciali, secondo quanto previsto dal testo unico sulla privacy n. 196 del 30/06/2003 e dal Regolamento dell’Unione Europea sulla privacy 2017/679 (GDPR/18);
• Concede agli organizzatori il più ampio consenso all’uso, nei modi consentiti dalle leggi, anche a fini di lucro, di ogni sua immagine video o fotografica ripresa nei giorni della manifestazione, fornendo all’organizzazione facoltà di cessione a terzi di tali immagini.
La suddetta autorizzazione all’utilizzo della propria immagine deve intendersi prestata a tempo indeterminato e senza limiti territoriali in tutto il mondo, per l’impiego in pubblicazioni e filmati vari, ivi inclusi, a mero titolo esemplificativo e non limitativo, materiali promozionali e/o pubblicitari realizzati su tutti i supporti. L’organizzazione potrà, inoltre, cedere a terzi e ai propri partner istituzionali e commerciali, i diritti di utilizzazione previsti nel presente accordo.
L’organizzazione declina ogni responsabilità per sé e per i suoi collaboratori, per incidenti o danni a persone o cose, che dovessero verificarsi prima, durante e dopo la manifestazione o per effetto della stessa.

Art. 14 – Trattamento e registrazione dei dati personali
Il trattamento e la registrazione dei dati personali sarà effettuato dalla seguente società:

I dati personali di tutti i partecipanti saranno trattati e registrati secondo quanto previsto dal testo unico sulla privacy n. 196 del 30/06/2003 e dal Regolamento dell’Unione Europea sulla privacy 2017/679 (GDPR/18).

The Grand Escape Tuscany is a non-competitive cycling event reserved exclusively for members of the Bikepacking Adventures ASD (henceforth also called event or adventure).

Art. 1 – Registration
All persons from all nationalities who have reached the age of 18 at the time of registration are admitted to the event.

Art. 2 – Membership
The Grand Escape Tuscany is an event reserved exclusively for members of the Bike Soul SSDrl. Those who are not members of the aforementioned sports club will become so when registering for the event. The Organization may, at any time and at its sole discretion, decide whether to accept the registration or exclude a member from the event if it may damage the image of the event.

ART. 3 – Medical certificate

All participants are REQUIRED to submit a valid “Health Certificate for cardiovascular intensive sport activity (cycling races/events)”. The medical certificate must be issued by your doctor and must be valid until 30 June 2023 and must be uploaded during registration.

If the medical certificate is not compliant, it will be refused and canceled and the member will have to submit a new compliant one by 30 June 2023.

The expiry date of the medical certificate must also be specified.

The Medical Certificate must be specific for CYCLING. We cannot accept medical certificates issued for other sports such as triathlon, athletics, etc.

Anyone who does not comply with this requirement won’t be admitted to the event and will not be entitled to a refund of the registration fee.

Art. 4 – Route and track
The route starts in Castagneto Carducci (LI) and ends in Castagneto Carducci (LI). The route has a length of about 600 km. The route runs on asphalted roads.

The organization will provide all participants with a complete route map to be followed until the arrival at Orbetello; it also informs that, at any time and for any safety reasons, as well as traffic and road conditions, including road works, driving bans, detours and any other unpredictable situation that may be encountered along the planned route, each participant is free, at his own discretion, to leave the route and resume it as soon as these critical conditions have ceased and safety will be guaranteed again. Therefore, participants can divert from the track provided at any time and resume it later, using alternative routes at their own discretion, if the conditions so require. The organization reserves the right to change the route until a few days before departure.

The detailed program of the event will be available to each participant via email.

Art. 6 – Compliance with the traffic laws
The The Grand Escape Tuscany is a FREE EXCURSION PEDALING on asphalt roads; the entire route will always be open to traffic and, therefore, it is mandatory for all participants to comply with the traffic laws. It is also mandatory to have a kit for repairs and punctures.

Art. 7 – Characteristics of the event – warning
All participants have to:
be physically prepared to face any long cycling periods
have off-road driving skills
be able to adapt themselves
be able to use GPS and basic orientation
In the spirit of bikepacking, any kind of external support is forbidden (except in case of emergency).

Art. 8 – Mandatory Kit
For their own personal safety, in the event of an emergency or loss of the route, each participant is obliged to carry with them, for the duration of their adventure, the following minimum safety equipment:

• reflective vest
• whistle or bell
• cell phone
• approved helmet to always wear
• front white and red rear lights

Art. 9 – Registration and participation fee
Registration opens: 1 April 2023
Entries close: 9 May 2023

Art. 10 – Validity of registration
The registration can be considered valid only after completing the electronic registration procedure with subsequent electronic crediting of the amount in favor of the organizer and sending the medical certificate which must be send by 30 June 2023 to info@admino

The Grand Escape organization may, at any time and at its sole discretion, without further reason, decide whether to accept the registration of any person.

Art. 11 – Substitution and waiver of participation
With reference to the event, it is not possible to request the substitution of a participant once he is registered. If a registered participant does not participate in the Event, the participation fee will not be refunded in any case and the competition pack will not be sent.

Art. 12 – Cancellation and change of location/date of the event
Cancellation – If, for reasons of force majeure such as pandemics or war, the event should not take place, the amount paid at the time of registration will not be refunded, but the participation fee alone will be considered valid in case of application for the next edition. The organization will also be entitled to a contribution regarding insurance costs equal to €14.00 for the postponement of the registration to the following year. The application for registration to the following year and the payment of the sport card and secretarial fee must be made within the date specified by the organization after the cancellation of the event.
Change of location/date – In addition, due to force majeure or other serious reasons such as pandemics o war, which could jeopardize the preparation of the event or the participation of at least half of the people registered, the Organization reserves the right to change the location and/or date of the event within the same calendar year. In this case, the fee paid for the registration will be valid for the event on the rescheduled date, without any additional cost for the members. However, it is not possible to transfer the registration to the following year’s edition.

Art. 13 – Changes
In the face of new environmental and/or health circumstances and/or changes in the regulatory framework, the Organization reserves the right to make the consequent reasonable changes to the regulations at any time. The official website of the event where these regulations are published constitutes the only reference for information on the event. Therefore, it will not be possible to invoke any different contents present in previous communications via newsletter, in the press or on social media.

Art. 14 – Approval, consent, authorization, etc…
By applying to the Grand Escape Tuscany, from the time of registration, each participant:
• declares to have read and approved these Regulations and to accept all parts of them;
• guarantees his conduct during and after the event;
• declares to be in good physical condition and to have given the organization a valid medical certificate after undergoing a medical aptitude examination for cycling practice, releasing the organization from liability for any damage that may be suffered as a result of his participation in the event;
• declares that he is aware that the event is non-competitive and has no rankings but just an order of arrival based on the personal timing in order to have a security check on all participants;
• declares to be aware that there is no health care, food and mechanical service from the organizers of The Grand Escape Tuscany cycling event;
• declares to be aware that there is no service for picking up participants who pulled out, nor are there any obligations on the part of the organizers;
• Declares to be aware that there is no obligation on the part of the organization to guard the roads crossed by the cyclists who are taking part in the event;
• declares to be aware that the participation fee will not be refunded in any case;
• declares to have experience and to be aware of the possibility of encountering adverse weather conditions and to be able to orient and cycle in the hills and medium mountains in such conditions;
• declares to be aware that the organizer “Bikepacking Adventures ASD” is not a professional organizer, but it acts only for recreational purposes and not for financial purposes (1174 Civil Code); therefore, the participation in the The Grand Escape Tuscany is always by free choice and for recreational purposes. It follows that the above-mentioned organizer, SSDrl, has not and, in any case, is released from any liability related to the The Grand Escape Tuscany tour. It is also released from any liability for events that occurred to the cyclist during the The Grand Escape Tuscany such as: accidents, loss of route, physical problems, theft, etc… Therefore, it follows that the The Grand Escape Tuscany cycling tour is intended to be a mere spontaneous and independent gathering of cyclists and amateur cyclists on free and personal tours;
• declares that, participating in the The Grand Escape Tuscany cycling tour, he waives any legal action in any capacity against the SSDrl organizer mentioned above, recognizing that it is a non-professional association acting for recreational purposes without the requirements (pursuant to art. 1174 Civil Code).
• declares to be aware that the trademarks and materials of the event are protected by copyright with EUIPO international license and, therefore, cannot be reproduced or modified without prior written authorization from the organizer.
• gives his consent to the use of his personal data, also for commercial purposes, in accordance with the provisions of the Privacy Consolidation Act no. 196 of 30/06/2003 and the European Union Privacy Regulation 2017/679 (GDPR/18);
• gives the organizers the widest consent to the use of any video and/or photographic images taken during the days of the event, in the manner permitted by law, including for profit, while giving the organization the right to transfer these images to third parties.
The aforesaid authorization to use one’s images must be understood as being given indefinitely and without territorial limits throughout the world, for use in various publications and videos, including, but not limited to, promotional and/or advertising materials on all media. The organization may also assign the rights of use provided for in this agreement to third parties and to its institutional and commercial partners.
The organization refuses any responsibility for itself and its collaborators, for accidents or damage to persons or things, which may occur before, during and after the event or as a result of it.

Art. 15 – Processing and registration of personal data

The processing and registration of personal data will be carried out by the following company:

The personal data of all participants will be processed and registered in accordance with the provisions of the Privacy Consolidation Act no. 196 of 30/06/2003 and the European Union Privacy Regulation 2017/679 (GDPR/18).
